Rajkot filmmaker to sue Hollywood producer for song piracy

Rajkot, July 15 ‘We created this song in 1984 and if anybody plays it unlawfully, then we will surely put up a legal fight’

Film producer Ranjit Herma is planning to file a case under the Copyright Act against the producer of the Hollywood movie Cloverfield.


The movie has used a famous Gujarati garba Pankhida O Pankhida as background music and credited it to Lekha Ratnakumar.

According to Rajkot-based Herma, who also owns a music studio named Studio Siddharth, it was his wife Vijaya Herma who had originally penned the lyrics of the song in 1984, while the famous Gujarati musician Pankaj Bhatt had scored the music.

"We created this song in 1984 and if anybody plays it unlawfully in some Hollywood movie, then we will surely put up a legal fight.

Recently, the producer of the Hindi movie Krazzy 4 was sued by a music composer for using his music. By God's grace I have ample money, but if I get anything from this fight then I will surely use it for charity.'' Herma said.

Pankhida O Pankhida Udine Jaje Pavagadh Re was recorded by Herma in famous Gujarati singer Hemant Chauhan's voice. The song was later used in the Hindi movie Agnikal (1989) directed by Abbas-Mustan and in the Gujarati movie Pankhida O Pankhida (1993) — both produced by Herma. The song became very popular everywhere.

Herma's legal advisor and senior lawyer of Rajkot, Abhay Bhardwaj, explained that they wanted to file a case in India but since US laws were stricter, they will file the case in USA with the help of senior Gujarati lawyers based there.

"My client and friend Herma has created this song and if someone steals it then we will fight for our right till the end. Compared to India laws in US are stricter. So, with help from our lawyer friends in US, we will file a case in a US court against Cloverfield producer J J Abraham. We will also file a case under the Copyright Act in India against Lekha Ratankumar who pirated this song and sold it to the Hollywood producer,'' said Bhardwaj.

According to Herma and Bhardwaj, this fight is not for money but for self-respect. Bhardwaj said: "Earlier people from abroad blamed our film and music industry for copyright violation, but this is the first instance when a Hollywood producer is at fault and we will not miss this chance. We don't want money but if the Cloverfield producer makes any out-of-court negotiation, we will accept it. We have decided that if we get any money, then half of it will be used for the sake of poor Indian singers and the rest would go to the Gujarati people living in the US who are fighting this case on our behalf.''

However, the addresses of both J J Abraham and Lekha Ratankumar are yet to be traced for the battle to even begin. The issue came to notice when an English daily printed an article on the Cloverfield soundtrack.
